Terms and Conditions

1. Definitions

• "Service"means the MenuCost web application, marketing website, APIs, and any related tools or documentation provided by us.
• "Account"means the account you create to access and use the Service.
• "User"means any individual who accesses the Service under your Account, including you and any additional users you invite.
• "Subscription"means the paid plan that grants access to the Service for a defined billing period.
• "Your Data"means all content you create, upload, or store within the Service — including ingredient libraries, recipes, staff records, overhead settings, catering quotes, and reports.
• "Free Trial"means the 7-day period during which you may use the Service at no charge before a Subscription begins.

2. Acceptance of these Terms

You accept these Terms by creating an Account, clicking "I agree" or a similar button, or by using the Service in any way. Your continued use of the Service after any update to these Terms constitutes acceptance of the updated version.

You must be at least 18 years old to use the Service. By accepting, you confirm that you meet this requirement.

3. Your account

Registration

To use the Service, you must create an Account with a valid email address and a password. You agree to provide accurate and complete information at registration and to keep it up to date.

Account security

You are responsible for keeping your login credentials secure and for all activity that occurs under your Account. Do not share your password with others. If you suspect unauthorised access to your Account, contact us immediately at support@menucost.net.

Additional users

Depending on your Subscription plan, you may invite additional Users to your Account. Each additional User is subject to these Terms. You are responsible for the actions of all Users under your Account.

One account per business

Each Account is for a single business entity. You may not create multiple Accounts to circumvent plan limits or access features not included in your Subscription.

4. Subscription and billing

Free trial

New Accounts receive a 7-day free trial with full access to the Service. No credit card is required to start the trial. At the end of the trial period, continued use of the Service requires an active Subscription. If you do not subscribe, your Account will be downgraded and access to paid features will be restricted.

Subscription plans

Subscription plans and pricing are published at menucost.net/pricing. Prices are in USD and are exclusive of any applicable taxes unless otherwise stated. Additional Users can be added to a Subscription at the per-user rate published on the pricing page.

Billing and payment

Subscriptions are billed in advance on a monthly or annual basis depending on the plan you select. Payment is processed by Lemon Squeezy, our payment processor and merchant of record. By subscribing, you authorise Lemon Squeezy to charge your payment method at each renewal date.

Taxes

Lemon Squeezy acts as merchant of record and is responsible for collecting and remitting VAT and other applicable taxes on our behalf in jurisdictions where required, including GCC member states. The tax-inclusive price will be shown at checkout.

Renewals and cancellation

Subscriptions renew automatically at the end of each billing period. You may cancel your Subscription at any time from your Account Settings. Cancellation takes effect at the end of the current billing period — you retain access to the Service until then and will not be charged again after cancellation.

Refunds

We do not offer refunds for partial billing periods. If you believe you have been charged in error, contact us at billing@menucost.net within 14 days of the charge and we will review your request.

Price changes

We may change Subscription prices from time to time. We will give you at least 30 days' notice of any price change by email. If you do not cancel before the new price takes effect, your continued use of the Service constitutes acceptance of the new price.

5. Permitted use

Subject to these Terms and your active Subscription, we grant you a non-exclusive, non-transferable, revocable licence to access and use the Service for your own internal business purposes — specifically, to manage recipe costing, ingredient libraries, menu profitability, staff cost tracking, overhead allocation, catering quotes, and allergen management for your food and beverage business.

This licence does not permit you to resell, sublicense, or provide the Service to third parties as a standalone product or managed service.

6. Prohibited use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation
• Attempt to gain unauthorised access to any part of the Service, its servers, or connected systems
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service
• Copy, modify, distribute, sell, or create derivative works based on the Service or its content without our written permission
• Upload, transmit, or store content that is illegal, harmful, defamatory, or infringes the intellectual property rights of any third party
• Use automated tools, bots, scrapers, or scripts to access or extract data from the Service without our prior written consent
• Interfere with or disrupt the integrity or performance of the Service or the data contained within it
• Use the Service to develop a competing product or service
• Share access to the Service with persons outside your business in a way that circumvents per-user pricing
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity

We reserve the right to suspend or terminate your Account immediately if we determine, in our sole discretion, that you have violated any of these prohibitions.

7. Your data

Ownership

Your Data belongs to you. We do not claim any ownership over Your Data. By using the Service, you grant us a limited licence to store, process, and display Your Data solely for the purpose of providing the Service to you.

Responsibility for your data

You are solely responsible for the accuracy and legality of Your Data. You represent that you have all necessary rights to upload and use Your Data within the Service and that doing so does not infringe any third-party rights.

Data export

You can export Your Data at any time from the Reports tab as an Excel workbook. We recommend keeping regular exports as backups.

Data deletion on termination

When you delete your Account, we will permanently delete Your Data within 30 days, except for billing records and transaction history which we are required to retain under Saudi Arabian tax law. See our Privacy Policy for full retention details.

How we handle your data

Our collection, use, and protection of personal data within Your Data is governed by our Privacy Policy, which forms part of these Terms.

8. Our intellectual property

The Service — including its software, design, architecture, features, user interface, trademarks, and all content created by us — is owned by AccountsEd Business Solutions and is protected by applicable intellectual property laws.

Nothing in these Terms transfers any ownership of our intellectual property to you. The licence granted in Section 5 is limited to use of the Service as described. All rights not expressly granted are reserved.

"MenuCost" and the MenuCost logo are trademarks of AccountsEd Business Solutions. You may not use our trademarks without our prior written consent.

9. Third-party services

The Service integrates with third-party providers including Supabase (database), Vercel (hosting), Lemon Squeezy (payments), and Resend (email). These providers operate under their own terms of service and privacy policies.

We are not responsible for the availability, accuracy, or conduct of third-party services. A disruption to a third-party service may temporarily affect the availability of the Service, and we will not be liable for such disruptions.

The Service may contain links to third-party websites. We do not endorse those websites and are not responsible for their content or practices.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. To the fullest extent permitted by applicable law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be error-free, uninterrupted, or free of viruses or other harmful components. We do not warrant that cost calculations, profitability analyses, or other outputs produced by the Service are accurate, complete, or suitable for any particular business decision.

The Service is a tool to assist your business operations. All decisions made using outputs from the Service — including pricing, hiring, purchasing, and financial planning — are your sole responsibility. MenuCost is not a substitute for professional accounting, legal, or financial advice.

11. Limitation of liability

To the fullest extent permitted by applicable law, AccountsEd Business Solutions, its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the Service — including loss of profits, loss of data, loss of goodwill, or business interruption — even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of or related to these Terms or the Service shall not exceed the total Subscription fees paid by you in the 12 months immediately preceding the event giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

12. Indemnity

You agree to indemnify, defend, and hold harmless AccountsEd Business Solutions, its directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses — including reasonable legal fees — arising out of or in any way connected with:

• Your use of or access to the Service
• Your violation of these Terms
• Your Data, including any claim that Your Data infringes a third party's intellectual property or other rights
• Any action taken by a User under your Account

13. Termination

Termination by you

You may cancel your Subscription and close your Account at any time from your Account Settings. Cancellation takes effect at the end of the current billing period. You may also request immediate deletion of your Account and data by contacting support@menucost.net.

Termination by us

We may suspend or terminate your Account at any time with or without notice if:

• You violate any provision of these Terms
• We believe your use of the Service poses a risk to us, other users, or third parties
• Your Subscription payment fails and is not resolved within 7 days of our notification
• We are required to do so by law or by order of a court or regulatory authority
• We decide to discontinue the Service, with at least 30 days' notice where reasonably possible

Effect of termination

On termination, your right to use the Service ceases immediately. We will delete Your Data in accordance with Section 7 and our Privacy Policy. Sections 7, 8, 10, 11, 12, and 15 survive termination.

14. Changes to these Terms

We may update these Terms from time to time to reflect changes in the Service, applicable law, or our business practices. When we make material changes, we will notify you by email and display a notice in the app at least 14 days before the changes take effect.

The version number and effective date at the top of this page always reflect the current version. Your continued use of the Service after the effective date of any update constitutes your acceptance of the updated Terms.

If you do not agree to updated Terms, you must stop using the Service and cancel your Subscription before the changes take effect.
